Community Improvement Plan
NOTICE OF ADOPTION
TAKE NOTICE that, in accordance with the provisions of the Planning Act, R.S.O. 1990, as amended, the Council of the Township of Manitouwadge on August 11, 2021, passed:
- By-law 2021-30, Being a By-law to Designate a Community Improvement Project Area for the Township of Manitouwadge.
- By-law 2021-31, Being a By-law to Adopt a Community Improvement Plan for the Township of Manitouwadge.
PUBLIC NOTICE regarding the proposed Plan was given in accordance with the requirements of the Planning Act, and where public consultation on the Draft Plan began on July 17, 2020 and public consultation on the Final Draft Plan began on May 27, 2021 to July 30, 2021.
TAKE NOTICE that the written and oral submissions received relating to this matter, have been, on balance, taken into consideration as part of the deliberations and final decision related to the approval of the Community Improvement Plan, as detailed within Staff Report ADM2021-33.
THE PURPOSE AND EFFECT of By-law 2021-31 is to adopt a Community Improvement Plan to facilitate and encourage ongoing revitalization and community development. The Community Improvement Plan provides a set of complementary initiatives and financial incentive programs to support ongoing community improvement and development within the Township of Manitouwadge.
The Community Improvement Plan applies to lands designated in the Community Improvement Project Area through By-law 2021-31. The Community Improvement Project Area is illustrated on the Key Map attached to the By-law. The By-laws, the Community Improvement Plan and the Community Improvement Project Area are available on the Township website https://www.manitouwadge.ca/government/by-laws/pdfs/ or upon request from Joleen Keough, the Township Clerk, whom may be contacted at the information noted below.
AND TAKE NOTICE that any person, corporation, public body or agency may appeal to the Ontario Land Tribunal (OLT) in respect of the Community Improvement Plan by filing with the Clerk of the Corporation of the Township of Manitouwadge a Notice of Appeal to the OLT, setting out the reason for the appeal and identifying any specific part or parts of the Plan to which the appeal applies. The appeal, together with the fee required by the OLT, must be filed no later than September 1, 2021. Please consult the Ontario Land Tribunal or 1-866-448-2248 for further information regarding how to file an appeal and the appeal process.
The Community Improvement Plan is exempt from approval by the Ministry of Municipal Affairs and Housing. The decision of Council is final if a notice of appeal is not received on or before the last day for filing a notice of appeal. Only individuals, corporations or public bodies may appeal a decision of the municipality or planning board to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf. No person or public body shall be added as a party to the hearing of the appeal unless, before the plan was adopted, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
